Customs Seized Gucci, LV, Chanel, Champion And Other Cross-Border Counterfeit Goods

        On April 27, the State Intellectual Property Office of the people's Republic of China released the "typical cases of intellectual property protection of China Customs". The report outlines 10 typical cases of infringement and counterfeit goods seized by the Chinese customs in 2020. Among them, counterfeit shoes and clothing accessories of famous brands account for a relatively high proportion. Luxury brands such as Gucci, LV, Chanel, Prada and other luxury brands have become the main counterfeiting objects, and the infringing goods of shoes and clothing accessories of sports brands such as SKECHERS, champion and Air Jordan have also become the focus of investigation.

        According to the case, in April 2020, when Qingdao Customs inspected a pullover declared for import by a Fujian science and Technology Co., Ltd., the inspectors checked the trademark information of the goods by relying on the "individual soldier system" and "trademark identification" app, and found that the batch of goods used the "champion" logo, which was suspected of infringement. Later, it was confirmed by the obligee that the pullovers were the infringing goods of "one day tour in the bonded area", totaling 9118 pieces, with a value of 319100 yuan. Due to the large amount of money involved in the case and suspected of committing a crime, Qingdao Customs immediately informed the public security organ of the clues of the case, asked the public security organ to intervene in advance and cooperate with the public security organ to fix the evidence in time. On this basis, the public security organs cracked down a series of extraordinary cases involving the sale of counterfeit registered trademark goods, including the Technology Co., Ltd., destroyed 5 fake sales outlets, realized the goal of "cracking down on gangs and end dens", arrested more than 20 criminal suspects, and seized more than 300000 counterfeit international famous brand clothing, including "champion", with a total amount of nearly 200 million yuan.

On September 30, 2020, Beijing Customs seized one ticket of declaration forms for export declared by a company in Linyi, including 9 items, including "storage bag, switch box, women's coat", etc. After unpacking inspection, it was found that the actual goods were glasses with "Gucci" and "ray ban", leather bags with "Lv", "Chanel" and sports shoes with "Prada" and "flying Jordan" etc., involving 18 commercial mark rights of more than ten obligees. All of them are infringing goods confirmed by the obligee. On the basis of the case, Beijing Customs further analyzed the customs clearance data and historical case data, extensively collected clues from obligees, and carried out precise control over the goods and articles of key routes between China and the United States. In 2020, a total of 547 batches of infringing goods, nearly 70000 pieces, worth more than 1.5 million yuan, were seized.

During the same period, in view of the fact that the number of goods sent out to the United States by postal channels in the Customs District has increased significantly, Fuzhou Customs has strengthened the analysis, precise control, and inspection and opening of packages. A total of 1379 batches of various kinds of infringing goods were seized and 1612 pieces of infringing goods, such as earphones, sunglasses, bracelets, watches, backpacks and thermos cups, were seized, with a value of 146000 yuan. The above infringing goods use "beats", "Bose", "Cartier", "Rolex", "Lv", "Gucci" and other marks, which infringe the trademark rights of the relevant obligees.

The General Administration of Customs said at the press conference that the infringement of goods was still dominated by infringement of trademark rights. According to the statistics of detained batches, clothing, shoes and hats, leather bags, electronic appliances and other goods occupied the top three batches, with 32000 batches, 16000 batches and 7000 batches respectively.
